초록

발달장애, 정신장애, 치매 등 정신적 장애가 있는 성인은 의사결정능력에 어려움을 겪더라도 자신이 지정한 대리인 또는 법정대리인의 지원을 받아 지역사회에서 독립생활을 영위할 수 있다. 그러나 이들은 공적 생활에서는 심한 제도적 차별을 받고 있다. 성년후견, 한정후견을 이용하는 경우, 300여개의 결격조항을 통해 사회생활 및 공적생활에 참여할 수 있는 권리, 자격, 권한이 박탈된다. 21대 국회의원 선거에 피성년후견인이 선거권을 행사할 수 있었던 것은 공직선거법이 개정되지 않는 바람에 반사적으로 얻은 정상상태의 회복일 뿐, 이것이 지속될지 불투명하다. 선거권이 인정되더라도, 정신적 장애인의 선거접근성은 현저히 떨어진다. 알기 쉬운 선거홍보물이 제공되지 않으며, 선거토론회에 정신적 장애인의 참여가 보장되지 않으며, 정신적 장애인 단체가 선거절차에 참여하거나 당사자 대표의 입후보를 보장 또는 지원하는 것은 논의조차 되지 않는다. 이 논문은 정신적 장애인의 참정권의 문제를 소극적으로 선거권 제한을 없앤다는 측면에서 바라보는 것에서 벗어나, 선거권 행사를 위한 정당한 편의제공, 나아가 선거참여를 증진시키는 것으로 확대되어야 한다는 인식 하에 그 필요성과 내용을 검토하였다. 이를 뒷받침하기 위해 정신적 장애인의 참정권 증진을 인권의 관점에서 접근하는 국제인권법의 변화를 유엔, 유럽평의회, 유럽연합을 중심으로 살펴보았다. 이를 토대로 우리나라에서의 과제로 정신적 장애인이 (법정)대리인을 이용하는 것과 공적 생활에 참여하는 자격제한을 연계시키지 않아야 한다는 것, 정신적 장애인 공동체가 단체를 형성하도록 지원하여 공적활동에의 참여를 촉진시키는 것이 필요하다는 것, 이를 통해 사회통합을 앞당길 수 있음을 제시하였다. 정신적 장애인의 참정권 증진을 위한 구체적인 과제로 이 논문은 선거정보접근성, 투표접근성, 피선거권 행사의 지원, 선거절차에 대한 정신적 장애인 단체의 참여를 제안하였다.

Although any adult has become a person with mental disabilities, due to developmental disability, mental illness, dementia and so on, he or she can live independently in communities with the assistance of either attorneys of the enduring power of attorney or legal representatives appointed by a competent authority. However, such adults have suffered severe discrimination in the public life. In the case that persons with severe disabilities among them are under full guardianship or limited guardianship, about 300 legal provisions deprive them of rights and power, which make them participate in full enjoyment of public life. Although adults under full guardianship participated in the 21th general election held in April, 2020, it does not mean the normalization to restore the suffrage to them, because the Electoral Act, which has deprived them of the voting right under the legal incapacity regime before 1. July, 2013, accidentally remains unchanged to the effect of losing its validity to persons under full guardianship. On the other hand, the other adults with mental disabilities have suffered many restraints in terms of fully participating in the public life. Especially their access to the vote procedure, on which the legitimacy of the government is supposed to be based, is significantly weak. Easy read vote materials have not been provided for, participation of persons with mental disabilities in the election discussions has not been guaranteed, and promoting their rights to be elected has never been on the agenda. This paper discusses the necessity of promoting the access of persons with mental disabilities to election with reasonable accommodation, from the perspective of UN disability convention. For this purpose, this paper analyzes the developments of international human rights of the persons with disabilities on the right to vote and to be elected through international human rights instruments, the decisions of the European Court of Human Rights, and the communication of the Committee on the Rights of Persons with Disabilities. In addition, this paper analyzes the endeavor by the Council of Europe and the European Union to promote the access of persons with persons with mental disabilities to elections with reasonable accommodation. Based on the such research, this paper proposes that the use by persons with decision making disabilities of (legal) representatives should be disconnected with their full participation in the public life such as election related rights, that helping building their community with assistance to organizing mental disability entities should rather be encouraged. This paper suggests the promotion of the access to the election information and the voting places, the encouragement of their candidacy, and their participation in the election procedure as concrete tasks.
