이 논문은 가사소송법 전부개정의 배경과 경위, 가사소송법 전부개정법률안의 특징과 몇 가지 주요 내용을 소개한 것이다.현행 가사소송법은 가사에 관한 소송과 비송 및 조정에 대한 절차의 특례를 규정함을 목적으로 하고 있지만(가사소송법 제1조), 가사사건절차의 기본법 내지는 통일법으로서의 역할을 하는데 불충분하다. 그래서 그 체재를 정비할 필요가 있으며, 당사자 및 사건본인의 절차보장, 국민의 법률접근성 확대 등 가사사건에 대한 국민인식과 사회상의 변화를 반영하기 위하여 전면적인 개정이 필수불가결하게 되었다.이 번 가사소송법 전부개정법률안은 가사소송법 시행 후 27년만의 첫 전면개정 작업의 결과물로 4년간에 걸쳐 완성된 것이다. 이 번의 전부개정법률안은 총 155개조로 이루어져 있다. 전부개정법률안은 가사사건 절차에서의 당사자 및 관계인의 절차보장강화를 위한 절차규정을 대폭 확충하였다. 또한 전부개정법률안은 가사사건에 관한 절차를 제도이용자인 국민이 이용하기 쉬운 것으로 구축하려고 노력하였다.오늘날 모바일 사회에서 증가하는 국제가사사건의 적절한 해결을 위하여 다음에는 가사사건의 국제재판관할, 외국가사재판의 승인･집행 등 절차규정의 신설도 고려하여야 할 것이다.

This study set out to examine the backgrounds and details of general revision of Family Litigation Act and introduce the characteristics and several core points of its general revision bill.The current Family Litigation Act has a goal of regulating special procedural cases regarding family litigation, non-litigation, and mediation(Article 1 of Family Litigation Act), but it falls short of serving as a basic act or unified act for family case procedures. It thus needs to arrange its system, and its overall revision is inevitable to expand people's access to law including the guarantee of procedures for the concerned parties and related person's perceptions of family cases and changes to the social aspects.This general revision bill of Family Litigation Act represents the first general revision in 27 years since the Act came into effect and took four years to complete. The general revision bill consists of total 155 articles, expanding considerably the procedural regulations to reinforce the guarantee of procedures for the concerned parties and related persons in the family case procedures. It also made efforts to establish family case procedures that would be easy for people to use in the system.The next revision bill will have to take into account the international jurisdiction of family cases and the approval and execution of overseas family case trials in the procedural regulations in order to solve international family cases, whose number is rising in today's mobile society, in a proper manner.
