구 정신보건법상 지역사회 정신질환자를 위한 복지와 지원 프로그램은 빈약하였고, 「장애인복지법」은 정신질환자를 정신장애인으로 규정하면서도 같은 법 제15조에서 이들을 보편적 장애인복지전달체계에서 배제하였다. 이에 「정신보건법」상 복지서비스 빈곤의 문제를 해결하기 위하여, 「정신보건법」을 전부 개정한 「정신건강증진 및 정신질환자의 복지서비스 지원에 관한 법률」이 성립되었다. 개정법은 정신장애인의 지역사회 통합을 위한 복지서비스의 제공에 관한 여러 규정을 신설함으로써, 「장애인복지법」과는 별도로 정신장애인의 복지서비스를 제공하는 정책을 선택하였다. 이러한 정책 전환에도 불구하고 지역사회에서 정신장애인의 회복과 통합에 긴요한 복지서비스 빈곤의 문제는 해결의 전망이 요원하고, 복지서비스 전달체계는 확립되어 있지 않다. 따라서 새로운 정책 목적을 실현하기 위하여 다음과 같은 조치들이 필요하다. 첫째, 정신건강복지법에 의한 복지서비스의 제공과 연계를 수행하기 위한 정신건강복지센타의 조직과 인력을 재편하여야 한다. 둘째, 정신장애인을 보편적 장애인복지서비스 전달체계에서 배제해 왔던 장애인복지법 제15조를 폐지하여야 한다. 셋째, 지역사회 장애인복지관 등에서 정신장애인에 대한 복지서비스를 제공할 수 있는 조직과 인력을 확보하여야 한다. 넷째, 정신장애인의 장애 특성을 고려하지 않은 서비스 제공기준을 개정하여야 한다. 그밖에도 정신장애인에 특유한 서비스 수요를 고려한 장애인의무고용제의 개선, 퇴원 정신장애인에 대한 특별한 주거 수요의 충족 나아가 장애인 쉼터와 같은 정신장애인에 고유한 복지서비스의 확보도 고려할 필요가 있다.

The old Mental Health Act had very insufficient welfare and support programs for people with mental illness at community in Korea. The Welfare Law for Persons with Disabilities stipulated that people with mental illness are the disabled legally but excluded them from the universal welfare delivery system for all of the disabled by article 15. The old Mental Health Act was completely amended to the Mental Health and Welfare Act to solve the problem of poor welfare services for people with mental illness in community. The new Act introduced various provisions concerning the welfare services to support people with mental illness in community. The new Act chose a policy to establish the welfare service delivery system only for people with mental illness apart from the universal welfare delivery system based on the Welfare Law for Persons with Disabilities. Despite the change of the policy, welfare services and their delivery systems for people with mental illness are established not enough to support the recovery and inclusion of people with mental illness in community.To realize new policy objectives, we must get over the following challenges : (1) the reorganization of the Mental Health and welfare Center to provide and link welfare services under the Mental Health and Welfare Act, (2) the abolition of Article 15 of the Welfare Law for Persons with Disabilities, which has excluded people with mental illness from the universal welfare service delivery system for all of the disabled, (3) preparation of mental health social worker in universal welfare service delivery system to be capable of providing welfare services for people with mental illness, (4) revision of the service provision criteria to take into account characteristics of people with mental illness, etc.
