초록: 

본 연구는 고령화시대 요양시설 입소자의 권익보호를 위한 기초연구로서 신체적 억제와 관련된 국제기준을 살펴보고 우리나라의 법과 제도에 있어서 어떻게 반영되고 있는지, 실제적인 연구동향을 살펴보는 것이다. 이를 위해 1982년 국제고령화행동계획, 1991년 노인을 위한 유엔원칙, 2008년 유엔장애인권리협약에 나타난 요양시설 입소노인의 신체적 억제에 적용할 수 있는 기준들을 제시하고 그러한 기준들이 국내의 노인복지법이나 관련 규범에 어떻게 반영되고 있는지 살펴보았다.그 결과 우리나라 노인의 인권은 국제기준의 원칙을 반영하면서 증진된 측면이 있으나 관련법은 노인의 인권을 광범위하게 보호하기보다는 노인의 보건복지증진에 초점을 맞추고 있으며 적극적으로 노인의 인권보호를 위한 조항은 부족하다. 특히 요양시설입소노인을 위한 인권매뉴얼은 노인을 위한 유엔원칙을 반영하여 입소노인의 존엄권, 신체적 자유, 자기결정권 등에 대해 규정하고 있으나 신체적 억제를 규제하는 명확한 기준이나 대안에 대한 제시가 부족할 뿐만 아니라 인지장애가 있는 노인의 특수성이 고려되어 있지도 않다. 관련하여 요양시설 입소노인의 신체적 억제에 대한 연구 또한 서비스 제공자의 입장에서 수행된 것이 대부분이고 신체억제 지침 개발, 인식과 태도가 주를 이루고 있다. 본 논문에서는 신체적 억제와 관련된 국제적 기준이 어떻게 규정되고 있으며 그것이 국내법에는 어떻게 반영되고 있는지와 이제까지의 신체적 억제와 관련한 연구동향을 검토하고, 향후 연구와 제도의 방향성을 제시하였다.

The purpose of this article is, as a basic study in the times of global aging population, to research current international standards for the protection on the rights of the older persons, especially in relation to physical restraints in facilities and how it reflected in domestic laws and to analyze the trend of research. For this purpose international criteria in relation to physical restraints is explored in International Plan of Action on Aging, The United Nation Principles for Older Persons and the Convention on the Rights of Persons with Disabilities(CRPD) and domestic criteria in Welfare of older persons Act, Act on long-term care insurance for older persons and Human Rights Manual for the elderly living in institutions.Although international human rights standards have gained increasing recognition within the realm of the rights of individuals generally, the rights of elderly persons in Korea have not yet reflected enough the international legal criteria.Research trend on physical restraints of elderly in facilities is analyzed through analysing journals published from 2005 to 2016. As results, research on physical restraints of elderly in facilities focused on attitudes to physical restraints or development of guidelines on physical restraints and educational programme and was lacked on ethical, legal and institutional standards about physical restraints.It is demanded to establish legal system to protect rights of elderly and to reflect willingness of older persons in facilities.
