본 논문은 어린이집 아동학대사건에 대한 사법조치사례를 분석하고, 그 문제점을 근거로 비사법적 접근을 대안으로 제안하였다. 사례를 통해 학대 발생부터 그 이후의 사법절차의 진행과정을 살펴보면서, 이전보다 강화된 사법조치가 학대행위자, 피해아동, 어린이집 운영자 등에 대하여 어떠한 영향을 미치는지, 이는 학대방지라는 법의 취지에 부합하는지 살펴보고자 하였다. 분석대상의 사례는 기존 학대사례집, 법원판결, 직접 조사 등으로 수집된 총 33개이며, 어린이집 원장 인터뷰를 통해, 구체적 내용을 보완하고자 하였다. 연구 결과, 어린이집 학대에 대한 처벌중심의 사법절차는 학대행위자는 물론 피해아동과 어린이집 운영전반에 부정적 영향을 미치는 측면이 있기 때문에, 자율적이고 비사법적인 접근으로 보완될 필요가 있었다.결론적으로, 어린이집 학대사건에 대한 자율적인 대응시스템은 비의도적이고 경미한 학대에 우선 적용될 필요가 있으며, 이를 어린이집차원과 지역사회차원에서 마련하되, 관련 당사자의 이익을 대변할 사람, 그리고 이를 조정하고 중재할 제3자(지역사회구성원)를 기본요소로 구성될 필요가 있음을 제안하였다.

This study analyzes the judicial approach to childcare centers’ abuse cases, and suggests the non-judicial approach as its alternative.Major methodology used for this study is case analysis of the criminal procedures in childcare center abuse cases. The objects of case analysis are a total of 33 cases from existing abuse casebooks, judgments of criminal courts and direct investigation, and interviews of childcare center directors were conducted.As a result, the criminal procedures upon childcare centers have an aspect of negative influences upon the abusers, victimized children and the management of childcare centers, and thus needed to be complemented by an autonomous and non-judicial approach. This corresponds with the perspectives and values of restorative justice and ADR in the judicial field.In conclusion, the autonomous response system for childcare center abuse cases needs to be first applied to unintended and minor abuses, and such response apparatus should be arranged by the childcare center and local community, consisting of a representative who will act in the interests of children and abusers (childcare centers), and a third party(member of local community) who will adjust and mediate between them as basic elements.
