UN은 2006년 장애인권리협약(CRPD) 채택 이후, CRPD 인권모델 원칙에 기반한 실천 가이드라인을 세계적으로 확산하기 위해 2012년에 ‘WHO QualityRIght Tool Kit’을 발간하였다. 한국은 CRPD 비준국으로서 인권모델 기반의 정신건강서비스 이행의 책무가 있다. 정신건강복지법, 장애인등급제 폐지 등 거시적 제도개선은 점진적으로 이행되고 있으나, 정신건강서비스 실천현장에서 인권모델의 실현은 매우 제한적이다. 툴킷은 UN CRPD 원칙에 기반한 정신건강 및 사회서비스 시설의 서비스 질과 인권기준 향상 및 사정을 위한 평가도구로, 인권모델 실천의 지향점을 구체적으로 제시해 주고 있다. 본 연구는 국내 최초로 툴킷의 국내 적용 가능성을 탐색하는 데 목적이 있다. 이를 위해 5개 정신재활시설을 대상으로 툴킷 실행 원칙에 따라 예비조사를 실시하였다. 조사대상시설은 툴킷 5개 테마에 대해 이용자의 인권을 ‘부분실현(A/P)’ 하는 것으로 평가되었다. 연구결과는 (1) 단기적으로는 기관의 인권모델 실천의 지표로서 툴킷활용이 가능할 것이며, (2) 장기적으로는 국가 차원의 서비스 평가 및 인권실현 정신건강서비스기관 인증 도구로 활용할 수 있는 가능성을 보여주었다.

Following the adoption of UN Convention on the Rights of Persons with Disabilities (CRPD), WHO published the QualityRights Tool Kit in 2012 to spread the practice guidelines based on the principles of CRPD human rights. As a ratifying country of CRPD, Korea is responsible for implementing mental health services based on human rights models suggested by CRPD. Although macro-systems such as the enactment of Mental Health Welfare Act and the abolition of disability rating system have been gradually improved, the actual practice of human-rights models is very limited in the fields of mental health practice. The WHO Quality Rights Tool Kit is a mental health and social care service evaluation tool based on the principle of the CRPD and specifically presents the direction of improving human-rights based practice. This study aims to explore the applicability of the Tool Kit in Korea. In order to achieve the research purpose, pilot tests were conducted involving five Mental Rehabilitation Facilities. Facilities are evaluated as “Achieved Partially(A/P)” of users’ human rights on the five themes of Tool Kit. Major findings are as follows. (1) In the short term, the Tool Kit will be available for mental health rehabilitation facilities as a standard of human-rights based practice for their own purpose. (2) In the long term, the Tool Kit will be possibly used as a tool for national mental health service evaluation to certify qualified human-rights practice institutions.
