초록: 

본 연구의 목적은 정신장애인 공공후견제도의 성과와 한계를 고찰하고이를 바탕으로 발전방향에 대한 함의를 논의하는 것이다. 이러한 목적을달성하기 위해서 2개의 후견기관과 2개의 피후견기관 전문가 16명을 대상으로 개별 및 집단면담을 하여 이를 주제 분석하였다. 분석 결과 성과, 한계, 발전방향의 세 가지 범주에 8가지 주제가 도출되었다. 후견제도의 성과로는 ‘자신의 의사를 표현할 수 있는 외부의 보호자’, ‘책임의 공유를 통한 인권보장의 안전장치’가 도출되었다. 후견제도의 한계로는 ‘입원제도개편에 따른 갑작스런 시행’, ‘참여기관들의 이해와 협력 부족’, ‘후견업무의 역할과 책임의 모호성’이 도출되었다. 발전방향으로는 ‘시설보호를 넘어선 지역사회 자립지원’, ‘다양한 의사결정지원으로의 확장’, ‘성년후견의제도적 근거 마련과 확대’가 도출되었다. 이러한 결과를 바탕으로 현재 시행되고 있는 정신장애인 후견제도에 대한 반성적 고찰을 통하여 향후 개선 및 발전방향에 대한 함의를 논의하였다.

This study aims to examine the achievement and limitations of public guardianship(PG) for individuals with psychiatric disabilities(IPD) and to discuss its future directions. In order to address these purposes, focus group interviews was done with specific focuses on the experience of professionals participated in PG services for IPD. A total of 16 professionals from four PG agencies participated in focus group interviews. Results can be summarized as follows. Participants presented three categories involving achievement, limitation, and future directions with 8 sub-themes. Concerning achievement, they expressed ‘having an external guardian’ and ‘sharing responsibilities.’ Concerning its limitations, they expressed ‘start without preparation and understanding of PG’, ‘lack of corporation mechanisms’, and ‘fuzzy roles and responsibilities of guardians.’ Concerning future directions, they mentioned ‘establishing community infrastructure’, ‘extension to various self-decision making for various services’, ‘establishing legal foundation of PG.’ Based on these results, implications were discussed for the future directions of the guardianship for individuals with PD.
