초록(국문) (*) 정신질환 발달장애 치매 뇌병변 등으로 의사결정능력에 장애가 있는 사람 이하 ( 의사결정능력 장애인) 역시 유엔 장애인권리협약상의 장애인이다.의사결정능력이란 결정할 어떤 사항에 관련된 정보를 수집하고, 수집된 정보를 분석·비교한 끝에 특정한 내용으로 의사결정을 한 후 이를 대외적으로 표시할 수 있는 능력을 의미한다. 의사결정에 필요한 정보를 수집할 능력은 장애만이 아니라 학력이나 경험에 의해 영향을 받을 수 있고, 수집된 정보를 분석·비교할 수 있는 능력 역시 장애, 학력, 본인의 성향 등에 영향을 받을 수 있으며, 이런 능력이 다 있다고 하더라도 어떤 의사결정을 하는지는 본인의 성향, 가치관, 희망, 욕구 등 다양한 요소에 의해 영향을 받는다. 본인의 의사결정을 대외적으로 전달할 수 있는 능력은 장애, 언어능력, 소통기술 등 다양한 요인에 의해 영향을 받는다.
초록(영문) This paper discusses about what supported decision making for persons with decision making disabilities is and which supported decision making schemes and how such schemes should be introduced in Korea. For this purpose, this paper analyses the current situation of substituted decision making system, and its limitation to help persons with decision making disabilities to live independently with their wishes, preferences and rights respected. In this regard, this paper criticizes current judicial guardianship and contractual guardianship services, which some experts argue that they can be a supported decision making scheme. Based on the limitation of current substituted decision making schemes including guardianship services reformed in 2011, this paper argues that introducing supported decision making schemes is indispensable and urgent, especially in the area of the provision of social benefits, namely social welfare assistances and services, because that provision is essential to those persons in need for daily living, care and medical treatments.On the contrary to traditional belief that the regulation by government of service providers can guarantee the quality of social welfare services and correct delivery of social welfare assistance, this paper argues that persons with disabilities as eligible holders of social benefit rights should participate in the decision making and delivery system of all the social benefits in order for individualized benefits to securely delivered with their wishes, preferences and rights respected. For that purpose, this paper suggests that individual supporters should be deployed to persons with decision making disabilities, and that those supporters should be selected by persons with disabilities themselves, or with their wishes and preferences respected in the cases where they cannot communicate to others at all, and that in the case of serious decision making pending, independent advocates are to be provided for.
