2017.9 통과된 개정 '사회복지사업법'은 '정신건강복지법'에 따른 정신질환자에 대 해 사회복지사 자격 취득의 결격대상자로 규정하였다. 비슷한 시기에 '약사법'은 약사 면 허취소 처분을 요구할 수 있도록 제한을 강화하였다. 이미 앞선 연구들에서 정신장애인에 대한 자격제한 문제가 수차례 제기되었다. 그럼에도 불구하고 이번 정신장애인에 대한 차별적 조치가 감행된 것은 세계적으로도 유례가 없을 뿐만 아니라 국가가 앞장 서 정신장애 인의 인권신장을 막은 행위라고 평가할 수 있다. '헌법'상 보장된 직업선택의 자유가 단지 정신장애인이라는 이유만으로 무차별적 제한되는 현실도 문제지만, 그 배경에 여전히 우리 사회가 정신장애에 대해 가지고 있는 편견과 낙인이 자리잡고 있다는 사실에 더욱 우려를 금할 수 없다. 이하에서는 정신장애인에게 있어 상징적인 이슈인 '사회복지사업법' 개정을 중심으로 정신장애인에 대한 자격제한 법률의 현황과 내용을 분석한다. 또한 우리와 유사 한 과정을 거친 일본의 입법개선 사례를 살펴보고, 사회적배제의 완화를 위한 개선방향으 로서 결격조항의 삭제 및 축소방안을 제안하고자 한다.

In Sep. 2017 the revised 'Social Welfare Services Act' regulates that persons with mental illness in accordance with the Mental Health Welfare Act, are disqualified from acquiring social worker qualifications. At a similar time, the 'Pharmaceutical Affairs Act' strengthened the restrictions so that the pharmacist’s license can be canceled if he has mental illness. The issues of limiting qualifications for mental illness have already been pointed out several times in prior studies. Nevertheless, the discriminatory measures against mental illness is evaluated as not only there is unparalleled worldwide, but also the nation suppress the human rights of persons with mental illness at the forefront. It is a problem that freedom of occupation guaranteed on the Constitution is indiscriminately restricted just for mental illness. But also, we can not help worrying more about the fact that the society still has the prejudices and stigma about mental disorders in the background. In the following, we will analyze the current status and contents of the qualification restriction act for mentally disordered, centered on the revision of the 'Social Welfare Service Act' which is a representative problem for people with mental disorders. In addition, I would like to propose deletion and reduction of disqualification provisions as a direction of improvement for mitigating social exclusion by seeing case of Japanese legislative improvement which undergone the similar process as ours. |
