장애인들은 오랫동안 차별과 편견 속에서 자신의 권리와 이익을 침해당해 왔다. 그러나 오늘날 장애인에 대한 인권의식의 고양됨에 따라 장애가 결코 권리의 제한이나 차별을 정당화하지 못하며, 오히려 장애인들이 비장애인과 동등하게 자신의 권리와 이익을 누리고 사회에 참여할 수 있도록 국가나 사회가 그들을 보호하고 지원하여야 한다는 이념이 사회적으로 수용되었다. 헌법상으로도 모든 국민은 인간으로서의 존엄과 가치를 가지고 행복을 추구할 권리를 가지며(헌법 제 10조 제1문), 모든 국민은 법 앞에 평등하므로(헌법 제11조), 장애인일지라도 비장애인과 동등한 조건에서 모든 권리와 이익을 향유할 수 있다. 그리고 국가는 개인이 가지는 불가침의 기본적 인권을 확인하고 이를 보장할 의무를 가진다(헌법 제10조 제2문). 따라서 국가나 사회는 장애인이 비장애인과 동등하게 모든 권리와 이익을 향유할 수 있도록 장애인에 대한 차별을 금지하고 그에 필요한 '합리적 편의(reasonable accommodation)'를 제공하여야 한다.

For the integration of the persons with mental disabilities in community, the state and community-society should not only provide the necessary welfare services but also defending system of the rights and interests and provide the support and assistance in which they need to exercise and enjoy their rights. In particular, sufficient support for decision-making of the persons with mental disabilities needs to be made before compulsory hospitalization. In introducing measures to promote rights and support for decision-making of the persons with mental disabilities in Korea, we reviewed the supported decision-making principles presented by QualityRights of WHO, and the supported decision-making model of Finland and Sweden. And we looked at the UK and Germany"s procedural aids and supported decision-making systems.
