정신건강복지법 시행 1년이 되는 시점에서 정신장애를 가진 사람들의 권리옹호를 위한 실천 과제를 자유권 측면, 사회권 측면, 회복 중심의 정신건강정책과 서비스 측면에서 정리 하였다. 자유권 측면에서는 강제입원과 관련하여 자타해 기준의 엄격한 적용과 사법입원제 도 도입, 입원 상태에서 권리보호를 위해 권리고지 안내와 면회,통신의 자유 제한의 예외 규정, 정신장애인 권익옹호제도 법제화가 요구된다. 사회권 측면에서는 정신장애인 복지차 별 해소를 위해 단기적으로는 정신건강복지법 제4장 복지서비스지원의 법 제33조에서 제 38조의 하위법령 제정과 지자체 단위에서 정신건강복지조례와 정신재활시설 확충을, 장기 적으로는 정신장애인의 의료서비스와 복지서비스 전달체계를 분리하여 복지서비스는 장애 인복지체계로 전환하고, 의사결정지원제도를 도입해야 한다. 마지막으로 정신건강정책과 정신건강서비스 실천의 핵심가치를 증상관리에서 인권과 회복으로 재설정하고, 당사자 의 전인적 회복을 지원하는 회복 중심의 정신건강정책과 서비스가 이루어져야한다.

At the first year of enactment of the Mental Health Welfare Act, the practical tasks for Rights Advocacy of people with mental disabilities proposed in three respects; in terms of the rights to freedom, the social rights, and in terms of the recovery oriented mental health policies and services. In the respect of the rights to freedom, it is required legislation of rights advocacy for people with mental disabilities. In terms of social rights, it needs to be expanded and improved the facilities, and in the long term to be imposed a system to support decision making. Finally, the practical core value of mental health policies is to be reset from “symptom management” to “human rights and recovery“. In conclusion, it proposed that recovery oriented mental health policies and services are provided. |
