노인장기요양보험제도가 시행된 이후 노인생활시설 수의 급격한 증가, 노인인권에 대한
사회적 인식의 변화 등을 통해 시설 내 노인인권에 대한 부분도 관심이 높아지기 시작하였
다. 특히 시설에서는 보호와 안전을 이유로 입소한 노인들에 대한 학대가 빈번히 발생하고
있다. 하지만 현재 노인복지법과 노인장기요양보험법에서는 노인복지시설 생활노인에 대
한 학대행위를 금지하는 매우 소극적 인권보호 이념을 규정하고 있다. 따라서 노인복지법
과 노인복지정책에서 보다 적극적 노인인권보호 이념을 수립하고 이를 뒷받침할 수 있는
세부적인 노인인권보호 정책을 개발하여 적극적으로 추진해 나가야 할 것이다. |

After the implementation of the longterm-care policy, facilities for elderly
has increased and perceptions of human rights for the elderly has also
increased. But elder abuse still occurs frequently in facilities for the elderly for
the reason of safety and protection. The current older person welfare law and
longterm-care law state that it is prohibited to the abusive behavior in the
facilities. But it is necessary to build more active protection regulation and
develop more detailed policy for old persons’human rights |
