최근 고령화와 출산율 저하 등 문제가 심각해짐에 따라 임의후견제도를 도입할 필요성과 급박성이 제기된다. 저명학자 정쉐런 교수는 임의후견제도가 현행 법정후견제도와 상호 보완하는 기능이 있고, 여러 가지 이유로 최대한 빨리 임의후견제도를 도입하고 명문화할 필요가 있다고 주장한다. 또한 유엔총회는 피성년후견인의 자기결정권을 중요시하고 차별을 받지 않으면서 평등하고 정상적으로 사회생활을 참여할 수 있도록 하고 있으며, 세계적 추세도 이와 같다. 결국 성년후견제도 입법은 국제적인 추세로 되었고 국제교류가 날로 많아지는 오늘날, 대만도 국제사회에 동 떨어질 수 없다. 2016년 10월 4일 대만 법무부가 추진한 ‘임의후견제도’ 신설초안과 2017년 12월 4일 법무부 ‘민법 친족편 ‘임의후견’제도 신설’ 제14차 회의자료는 성인이 의식이 분명할 때 스스로 혈연관계 유무와 관계없이 후견인을 선정하도록 하였다. 또한 임의후견의 권리의무에 있어 일본 민법상의 명문규정을 참조함으로써 가정의 자녀가 적어지고 사회 고령화의 부담을 덜어줄 것을 기대한다. 앞으로 대만 입법에서 임의후견제도를 조속히 도입하여 사회복지국가를 건설할 것을 기대한다. |

As the aging population and the declining fertility rate become serious, it is necessary and urgent to introduce arbitrary guardianship system. The arbitrary guardianship system is complementary to the existing legal guardianship system, and it is necessary to introduce and to register the arbitrary guardianship system as soon as possible because of its various merits. In addition, the UN General Assembly makes it possible to equitably and regularly participate in social life, without discrimination, with the right of self-determination of the adult guardians, and the global trend is the same. In the end, the adult guardianship legislation became an international trend, and nowadays, as international exchange is increasing day by day, Taiwan can not keep up with the international society. In addition, it is expected that the number of children in the family will be reduced and the burden of aging society will be relieved by referring to the prestigious regulations in the Japanese Civil Law in the right of arbitrary guardianship. In the future, I expect to introduce a social security system in Taiwan legislation and build a social welfare state. |
