초록: 

본 연구의 배경 및 목적은 1995년 정신보건법 제정 이후 급속히 증가한정신병상이 입ㆍ퇴원과정에서의 인권적 통제장치가 강화된 정신건강복지법 개정 이후에도 지속적으로 유지되는 이유를 의사결정지원제도의 부재라는 관점에서 조명해보고자 하는 것이다. 이러한 목적의 달성을 위해서의사결정지원의 개념과 유형, 정신의료기관 입ㆍ퇴원제도 그리고 정신장애인에서 특수한 의사결정지원의 필요성을 문헌자료를 통해 검토하였다.그리고 관련단체의 논란 속에 정신의료기관 입ㆍ퇴원과정에서의 의사결정지원제도로서 도입된 우리나라 절차보조제도를 영국과 일본의 사례와비교ㆍ분석하였다. 그리고 이러한 논의를 바탕으로 절차보조서비스의 발전을 위해서는 첫째, 서비스 대상에서 강제입원명령뿐만 아니라 외래치료명령을 받을 정신장애인도 포함시킬 필요가 있으며, 둘째, 권익침해의 사전예방과 서비스대상의 확보를 위하여 사전지시서 적극 활용과 공적 등록체계 구축이 요구되고, 셋째, 절차보조사업과 지역사회 권익옹호체계를연계할 필요가 있으며, 넷째, 정신장애인 동료지원가 참여를 확대하여야한다는 것을 제언하였다. 마지막으로 제도의 실효성 확보를 위한 주요 과제로서 절차보조서비스 법제화가 필요함을 제시하였다

The background and purpose of this study is to shed light on why the number of mental hospital is maintained continuously even after the revision of the Mental Health and Welfare Act in view of the absence of a decision-making support system. In order to achieve this goal, the concepts and types of decision-making support, the admission and discharge system of mental health institutions, and the special need for decision-making support of the person with mental disabilities were reviewed in the literature. And Korean procedural support system introduced as the decision-making support system for rights and interests was compared and analyzed with the cases of Britain and Japan. Based on these discussions, the following suggestions were made for the development of procedural assistance services. First, the scope of the service should be expanded to those with mental disabilities who will receive orders to treat the community. Second, advance medical directives should be actively utilized and the public registration system should be established to prevent infringement of rights and secure service targets. Third, it is necessary to establish a community rights protection system linked to the procedural support service. Fourth, participation of peer support for mental disorder should be expanded. Fifth, procedural support services need to be enacted.
