최근 보건의료 및 복지 전반에서 국가의 역할이 확대되고 있고 행정 영역에서의 의사결정 지원은 본질적으로 행정법학의 연구 대상임에도 불구하고, 그동안 이에 대한 논의는 거의 이루어지지 않았다. 개인의 생활영역은 공사법 전체에 걸쳐 있는바, 재산관리ㆍ신상보호ㆍ의료행위 동의뿐만아니라 사회보장급여의 신청 등 사인의 공법행위에서도 개인의 의사결정능력이 전제되어야 한다. 이 글은 의사결정 지원에 있어서 행정의 역할이강화되어야 한다는 기조 하에, 발달장애인에 대한 지원을 중심으로 의사결정 지원의 함의와 근거를 확인하고 행정 영역에서 이루어지는 의사결정지원에 대해 논하고자 한다. 먼저, 후견제도 이용에 대한 행정적 지원으로서 발달장애인 공공후견지원제도를 분석한다. 공공후견지원사업이 진정한 의사결정 지원제도로서기능하기 위해서는, 공공후견인에 대한 교육과 지도ㆍ감독에 대해 공적 책임과 역할을 강화하는 방향으로 관련 법규를 해석하고 제도를 운영해야한다. 이를 위해서는 이러한 사무가 과연 국가나 지방자치단체의 사무로서해석될 수 있는지, 공공후견지원제도에서 이러한 사무에 대한 권한과 책임귀속은 어떠한지 -특히 공공후견법인의 역할과 관련하여 행정사무의 민간위탁으로 파악할 수 있는지- 행정법적 관점에서 검토한다. 또한, 의사결정 지원은 복지서비스 신청을 비롯한 사회보장급여의 각 단계에서 일정한 행정절차를 보장하는 방식으로도 가능하다. 특히 의사결정능력이 부족한 사람들의 사회보장수급권을 보장하기 위해서는 사회보장급여 신청 과정에서 의사결정 지원이 요구된다. 이러한 관점에서 사회보장급여에 있어서 행정청의 조사의무 및 정보제공 및 발달장애인을 위한 개별화 지원계획 수립 단계에서의 절차 보장에 대해 검토한다. 한편, 행정 영역에서 이와 같은 의사결정 지원이 이루어지기 위해서는 의사결정능력에 대한 판단이 선행되어야 하는바, 행정 영역에서의 의사결정능력 판단에 관한 독자적 기준과 절차가 마련되어야 한다.

Although the role of the state is recently expanding in health care and welfare and administrative decision support is essentially related with administrative law, little discussion has been made on it. Decision-making competence should be needed not only in property management, personal protection, and medical treatment consent, but also in applying for social security benefits. This article aims to confirm the implications and grounds of decision support and discuss administrative decision support with the view that the role of administration in decision support should be strengthened, focusing on support for people with developmental disabilities. First, this article analyzes the public guardianship support project for developmental disabled people as an administrative decision support. In order to make public guardianship support project a true decision support system, it is necessary to interpret related laws and operate the system in a direction to strengthen public responsibilities and roles for education, guidance and supervision of public guardians. This article analyzes whether such affairs can be interpreted as a national or local affairs, and what the powers and responsibilities of the government in such affairs are. Also, it is necessary to guarantee some administrative procedures to support decision-making in social security benefits application. This article reviews the role of administration in investigating and providing information, and ensuring some administrative procedures in the stage of establishing an individualized support plan. In addition, its own standards and procedures of evaluating the decision-making competence in the administrative domain should be made.
