본 연구는 캐나다 온타리오주의 비자의입원 및 지역사회치료명령 제도를 검토함으로써 정신장애인에 대한 비자의치료제도 개선에 함의를 도출하는 데 목적이 있다. 온타리오주는 2011년 정신건강⋅ 중독 전략 ‘Open Minds, Healthy Minds’를 발표하며 포괄적 정신건강정책을 지향하고 있다. 정신장애의 개념을 광범위하게 정의함으로써 정신장애인에 대한 낙인을 줄이고 서비스 접근성 향상을 위한전략을 추진하고 있다. 온타리오주의 비자의입원, 지역사회치료명령제도는 개인의 자유와 권리 보장의 측면에서 다른 주에 비교해 상대적으로 전향적이다. 그럼에도 불구하고 비자의치료는 개인의 자유를 상당 부분 침해한다고 지적되고 있으며, 이를 보완하기 위해 다양한 대안이 시도되고 있다. 연구를통해 국내 정신질환자에 대한 낙인 감소를 위한 포괄적 전략, 동료지원가 중심의 절차보조서비스 제도화, 시설과 지역사회의 연계, 공공후견⋅신탁사무소 설치, 권익옹호를 위한 세부 법률 제정의 함의를 제시하였다.

The purpose of this study is to suggest implications for the improvement of the involuntary treatment system for people with mental illness in Korea by reviewing the mental health system (involuntary treatment and CTO) in Ontario, Canada. The Government of Ontario announced its mental health and addiction strategy "Open Minds, Healthy Minds" in 2011, aiming for comprehensive mental health policy. By broadly defining the concept of mental disability, the government is pushing for strategies to reduce the stigmas for the mentally disabled and improve service accessibility. Ontario’s involuntary admission and CTO are relatively forward-looking compared to other states in terms of individual freedom and rights. Nevertheless, it is pointed out that involuntary treatment violates individual freedom, therefore various alternatives are being tried. The results of this study suggest the following implications in Korea: need for a comprehensive strategy to reduce stigma, legislation of peer-led procedure support service, connection between facilities and communities, establishment the Office of the Public Guardian and Trustee, and enactment of specific laws to protect human rights.
